Acceptable Use Policy
This Acceptable Use Policy ("Policy") explains the rules governing the use of the Tool-O Platform.
1. INTRODUCTION
1.1 Purpose
This Acceptable Use Policy ("Policy") explains the rules governing the use of the Tool-O Platform.
It is designed to promote a safe, lawful, fair and trustworthy marketplace for all Users.
This Policy forms part of the Tool-O Terms of Use.
1.2 Application
This Policy applies to all Users of the Platform, including:
- Owners;
- Borrowers;
- visitors;
- guests;
- businesses;
- organisations;
- anyone accessing or using the Platform.
1.3 Compliance
Users must comply with:
- this Policy;
- the Terms of Use;
- applicable laws;
- all Platform policies;
- reasonable directions issued by Tool-O.
Failure to comply may result in action including suspension, cancellation of Bookings, Account restrictions or permanent removal from the Platform.
1.4 Tool-O Marketplace
Tool-O operates as an online marketplace connecting Owners and Borrowers.
Users remain responsible for their own conduct and compliance with applicable laws.
Nothing in this Policy limits any rights available to Tool-O under the Terms of Use or applicable law.
1.5 Updates
Tool-O may amend this Policy from time to time.
The latest version published on the Platform replaces all previous versions.
2. PROHIBITED ACTIVITIES
Users must not use the Platform to engage in unlawful, dishonest, unsafe or inappropriate conduct.
Without limitation, the following activities are prohibited.
2.1 Illegal Activities
Users must not:
- violate any applicable law;
- facilitate criminal activity;
- launder money;
- finance terrorism;
- engage in fraud;
- evade taxes or regulatory obligations;
- use the Platform for any unlawful purpose.
2.2 False Information
Users must not:
- provide false identities;
- impersonate another person;
- use fake documents;
- provide misleading information;
- create fake Listings;
- submit false claims;
- manipulate reviews.
2.3 Fraudulent Conduct
Users must not:
- attempt payment fraud;
- misuse Security Deposits;
- intentionally damage Tools;
- fabricate evidence;
- submit dishonest reimbursement requests;
- abuse Platform protections;
- engage in insurance fraud where applicable.
2.4 Account Misuse
Users must not:
- share Accounts;
- create multiple Accounts to avoid restrictions;
- allow unauthorised persons to use their Account;
- buy or sell User Accounts;
- transfer Accounts without Tool-O's approval.
2.5 Interference with the Platform
Users must not:
- interfere with Platform operations;
- disrupt services;
- overload systems;
- attempt to disable security measures;
- introduce malicious software;
- exploit software vulnerabilities;
- interfere with other Users' access.
2.6 Unauthorised Access
Users must not attempt to:
- hack the Platform;
- bypass authentication systems;
- gain unauthorised access to Accounts;
- access restricted systems;
- obtain confidential information without authority.
2.7 Automated Activity
Unless expressly authorised by Tool-O, Users must not:
- scrape Platform data;
- harvest User information;
- use bots;
- use automated scripts;
- use automated purchasing systems;
- interfere with search results.
2.8 Spam
Users must not:
- send unsolicited communications;
- send spam messages;
- distribute chain letters;
- conduct phishing attacks;
- send malicious links;
- distribute malware.
2.9 Misuse of Communications
Users must not use Platform messaging to:
- harass others;
- threaten others;
- discriminate;
- intimidate Users;
- advertise unrelated products or services;
- conduct transactions outside the Platform where doing so breaches the
Terms of Use.
2.10 Circumvention
Users must not intentionally circumvent:
- Platform fees;
- payment systems;
- Booking processes;
- safety procedures;
- identity verification requirements;
- Platform protections.
2.11 Intellectual Property Infringement
Users must not:
- upload copyrighted material without permission;
- misuse trademarks;
- infringe patents;
- copy Platform content without authorisation;
- violate another person's intellectual property rights.
2.12 Other Misconduct
Users must not engage in any conduct that Tool-O reasonably believes:
- endangers Users;
- damages the Platform;
- undermines marketplace trust;
- creates unreasonable legal risk;
- materially interferes with the proper operation of the Platform.
3. USER CONDUCT
3.1 General Standard
Users must behave honestly, respectfully and responsibly when using the Platform.
Users must not engage in conduct that is unsafe, misleading, abusive or inconsistent with the purpose of the Tool-O marketplace.
3.2 Respect for Other Users
Users must:
- communicate respectfully;
- act honestly;
- cooperate in good faith;
- respect agreed Booking arrangements;
- treat other Users fairly.
3.3 Harassment
Users must not:
- harass;
- bully;
- intimidate;
- stalk;
- threaten;
- abuse;
- discriminate against;
- deliberately provoke other Users.
Harassment through messages, reviews or any other Platform feature is prohibited.
3.4 Discrimination
Users must not discriminate against another person based on any protected characteristic recognised under applicable law, including:
- race;
- ethnicity;
- nationality;
- religion;
- disability;
- age;
- sex;
- gender;
- sexual orientation;
- marital status;
- family responsibilities.
Nothing prevents Users from complying with lawful safety or legal requirements.
3.5 Violence
Users must not:
- threaten violence;
- encourage violence;
- promote criminal conduct;
- incite unlawful behaviour;
- make credible threats against any person.
3.6 Offensive Content
Users must not upload, publish or communicate content that is:
- abusive;
- obscene;
- hateful;
- defamatory;
- discriminatory;
- sexually explicit;
- misleading;
- unlawful.
3.7 Illegal Content
Users must not use the Platform to distribute or promote:
- illegal goods;
- stolen property;
- counterfeit products;
- unlawful services;
- prohibited weapons;
- illegal drugs;
- malicious software;
- any material prohibited by applicable law.
3.8 Respect for Property
Users must treat all Tools and related property with reasonable care.
Users must not intentionally:
- damage property;
- misuse equipment;
- remove identification labels;
- tamper with safety devices;
- conceal damage.
3.9 Honesty
Users must deal honestly with Tool-O and other Users, including when:
- creating Accounts;
- creating Listings;
- making Bookings;
- submitting Claims;
- communicating through the Platform;
- leaving reviews.
3.10 Cooperation
Users agree to reasonably cooperate with Tool-O during investigations involving:
- safety concerns;
- fraud;
- Claims;
- disputes;
- payment issues;
- legal compliance.
3.11 Good Faith
Users must exercise their rights under the Platform reasonably and in good faith.
Users must not abuse Platform processes, repeatedly submit unreasonable complaints or otherwise misuse Tool-O services.
3.12 Marketplace Integrity
Users must conduct themselves in a manner that supports the integrity, safety and reputation of the Tool-O marketplace.
Conduct that materially damages User trust or the proper operation of the Platform may result in enforcement action under the Terms of Use.
4. LISTINGS
4.1 Accurate Listings
Owners must ensure that every Listing is accurate, complete and not misleading.
Listings must accurately describe the Tool being offered for rent.
4.2 Required Information
Listings should include, where applicable:
- accurate photographs;
- make and model;
- condition;
- specifications;
- included accessories;
- operating requirements;
- safety information;
- collection or delivery options;
- availability;
- pricing.
4.3 Photographs
Users must not upload photographs that:
- are misleading;
- materially misrepresent the Tool;
- infringe another person's intellectual property rights;
- contain offensive content;
- contain malicious or unlawful material.
Photographs should reasonably represent the current condition of the Tool.
4.4 Availability
Owners must make reasonable efforts to ensure that advertised availability is accurate.
Repeated cancellations due to inaccurate availability may result in Platform action.
4.5 Pricing
Listings must accurately state:
- rental pricing;
- delivery fees where applicable;
- any optional charges permitted by the Platform.
Users must not manipulate pricing to avoid Platform fees or mislead Borrowers.
4.6 Safety Information
Owners should disclose any information reasonably necessary for the safe operation of the Tool.
This may include:
- operating limitations;
- maintenance issues;
- required protective equipment;
- known faults affecting safe use.
4.7 Prohibited Listings
Users must not create Listings that:
- are fraudulent;
- are misleading;
- advertise stolen property;
- promote illegal goods or services;
- breach applicable laws;
- violate another person's rights;
- contain prohibited content.
4.8 Intellectual Property
Users must only upload content that they own or are authorised to use.
By uploading Listing content, Users confirm that they have the necessary rights to do so.
4.9 Updates
Owners should promptly update Listings where material information changes, including:
- availability;
- condition;
- pricing;
- delivery options;
- included accessories.
4.10 Removal of Listings
Tool-O may remove, suspend or restrict any Listing that reasonably appears to:
- breach this Policy;
- breach the Terms of Use;
- create safety concerns;
- expose Users to unreasonable risk;
- damage the integrity of the Platform.
4. LISTINGS
4.1 Accurate Listings
Owners must ensure that every Listing is accurate, complete and not misleading.
Listings must accurately describe the Tool being offered for rent.
4.2 Required Information
Listings should include, where applicable:
- accurate photographs;
- make and model;
- condition;
- specifications;
- included accessories;
- operating requirements;
- safety information;
- collection or delivery options;
- availability;
- pricing.
4.3 Photographs
Users must not upload photographs that:
- are misleading;
- materially misrepresent the Tool;
- infringe another person's intellectual property rights;
- contain offensive content;
- contain malicious or unlawful material.

- expose Users to unreasonable risk;
- damage the integrity of the Platform.
5. BOOKINGS AND TRANSACTIONS
5.1 Good Faith
Users must make and accept Bookings in good faith.
Bookings must not be created for fraudulent, misleading or unlawful purposes.
5.2 Accurate Information
Users must provide accurate information when making or accepting a Booking, including where applicable:
- collection arrangements;
- delivery arrangements;
- contact information;
- authorised recipients;
- special requirements.
5.3 Payment
All payments required by the Platform must be made through Tool-O's approved payment systems unless Tool-O expressly authorises otherwise.
Users must not attempt to avoid Platform payment processes.
5.4 Off-Platform Transactions
Users must not encourage or request another User to complete a transaction outside the Platform where doing so:
- avoids Platform fees;
- circumvents Platform protections;
- interferes with Tool-O's services;
- breaches the Terms of Use.
5.5 Booking Obligations
Owners and Borrowers must make reasonable efforts to:
- arrive on time;
- communicate delays;
- comply with agreed handover arrangements;
- complete collection and return procedures honestly;
- cooperate where unexpected circumstances arise.
5.6 Cancellations
Users must not repeatedly cancel Bookings without reasonable justification.
Excessive cancellations may result in restrictions or other Platform action.
5.7 Collection
Borrowers must only collect Tools in accordance with the agreed Booking arrangements.
Borrowers must not collect a Tool before the agreed commencement of the Booking unless authorised by the Owner.
5.8 Returns
Borrowers must return Tools:
- on time;
- in substantially the same condition, allowing for fair wear and tear;
- with all agreed accessories;
- to the agreed location;
- in accordance with Platform procedures.
5.9 Handover Records
Users should accurately complete any handover procedures made available through the Platform, including:
- photographs;
- condition reports;
- confirmations;
- timestamps;
- other evidence reasonably requested by Tool-O.
5.10 Claims
Users must submit Claims honestly and provide genuine supporting evidence.
Knowingly submitting false or misleading evidence is prohibited.
5.11 Platform Cooperation
Users must reasonably cooperate with Tool-O during investigations relating to:
- Bookings;
- payments;
- Claims;
- disputes;
- fraud;
- safety incidents.
5.12 Marketplace Integrity
Users must not manipulate Booking activity to:
- inflate reviews;
- improve rankings;
- generate false transaction history;
- mislead other Users;
- abuse promotional offers;
- interfere with Platform operations.
6. SAFETY REQUIREMENTS
6.1 General
Safety is a shared responsibility between Tool-O, Owners and Borrowers.
Users must use the Platform in a manner that promotes the safe rental and use of Tools.
6.2 Safe Use
Borrowers must:
- use Tools safely;
- use Tools only for their intended purpose;
- follow manufacturer's instructions where available;
- exercise reasonable care;
- comply with applicable laws;
- stop using a Tool if it appears unsafe.
6.3 Owner Responsibilities
Owners should make reasonable efforts to ensure that a Tool offered for rent:
- is in a reasonably safe condition;
- is suitable for its intended purpose;
- is accurately described;
- does not contain known undisclosed defects that materially affect safe
use.
6.4 Unsafe Tools
Owners must not knowingly rent a Tool that:
- presents an unreasonable safety risk;
- has a serious undisclosed defect;
- has been modified in a manner that creates unreasonable danger;
- is prohibited from being rented under applicable law.
6.5 Personal Protective Equipment
Borrowers are responsible for obtaining and using any personal protective equipment reasonably required for the safe use of a Tool unless otherwise agreed between the parties.
Examples may include:
- safety glasses;
- gloves;
- hearing protection;
- helmets;
- protective footwear;
- respiratory protection.
6.6 Training
Borrowers should ensure that they have sufficient knowledge and skill to safely operate a Tool before use.
Where appropriate, Borrowers should seek instruction from the Owner, manufacturer or another suitably qualified person.
6.7 Alcohol and Drugs
Users must not operate Tools while impaired by:
- alcohol;
- illegal drugs;
- medications that significantly impair safe operation;
- any other substance affecting judgement or coordination.
6.8 Children
Users must take reasonable steps to prevent children or unauthorised persons from using rented Tools unless such use is lawful, safe and appropriately supervised.
6.9 Reporting Safety Concerns
Users should promptly report to Tool-O any Tool or conduct that reasonably appears to:
- create a serious safety risk;
- involve dangerous misuse;
- present an immediate hazard;
- threaten another User's safety.
6.10 Emergencies
Where an immediate threat to life, health or property exists, Users should first contact the appropriate emergency services before notifying Tool-O.
6.11 No Safety Guarantee
Tool-O does not inspect every Tool listed on the Platform and does not guarantee that every Tool is safe, defect-free or suitable for a particular purpose.
Users remain responsible for exercising their own judgement and taking appropriate safety precautions.
6.12 Enforcement
Tool-O may suspend or remove Listings, restrict Accounts or take any other reasonable action where it believes continued use of the Platform may create an unacceptable safety risk.
6. SAFETY REQUIREMENTS

- use Tools safely;

- comply with applicable laws;
- stop using a Tool if it appears unsafe.
6.3 Owner Responsibilities
Owners should make reasonable efforts to ensure that a Tool offered for rent:

- is suitable for its intended purpose;
- is accurately described;
- does not contain known undisclosed defects that materially affect safe
use.
6.4 Unsafe Tools
Owners must not knowingly rent a Tool that:
- presents an unreasonable safety risk;
- has a serious undisclosed defect;
- has been modified in a manner that creates unreasonable danger;
- is prohibited from being rented under applicable law.
6.5 Personal Protective Equipment
Borrowers are responsible for obtaining and using any personal protective equipment reasonably required for the safe use of a Tool unless otherwise agreed between the parties.

7. ENFORCEMENT
7.1 General
Tool-O may investigate any suspected breach of this Acceptable Use Policy, the Terms of Use or any other Platform policy.
Users agree to reasonably cooperate with any investigation conducted by Tool-O.
7.2 Investigation
Tool-O may investigate conduct including:
- suspected fraud;
- payment irregularities;
- safety incidents;
- prohibited Listings;
- misuse of the Platform;
- abuse of other Users;
- suspected unlawful activity;
- breaches of Platform policies.
7.3 Requests for Information
During an investigation, Tool-O may request information including:
- photographs;
- videos;
- invoices;
- repair quotations;
- identity documents;
- communications;
- Booking records;
- other evidence reasonably relevant to the investigation.
Users must not knowingly provide false or misleading information.
7.4 Immediate Action
Where Tool-O reasonably believes that urgent action is necessary to protect Users, the Platform or the public, Tool-O may immediately:
- suspend an Account;
- remove a Listing;
- pause a Booking;
- delay a payment;
- retain funds where permitted by law or the Terms of Use;
- restrict Platform access.
7.5 Enforcement Measures
Depending on the circumstances, Tool-O may take one or more of the following actions:
- issue a warning;
- require corrective action;
- remove content;
- remove Listings;
- suspend Bookings;
- restrict Account functionality;
- suspend an Account;
- permanently terminate an Account;
- refuse future access to the Platform.
7.6 Serious Misconduct
Serious or repeated breaches may result in permanent removal from the Platform without prior notice where permitted by law.
Examples may include:
- fraud;
- repeated safety breaches;
- intentional damage;
- identity misuse;
- criminal conduct;
- serious harassment;
- deliberate circumvention of Platform protections.
7.7 Reporting to Authorities
Where appropriate, Tool-O may report suspected unlawful conduct to:
- law enforcement agencies;
- regulatory authorities;
- courts;
- insurers;
- payment providers;
- other authorised organisations.
7.8 No Waiver
A decision by Tool-O not to enforce this Policy on one occasion does not prevent Tool-O from enforcing it at a later time.
7.9 Other Rights
This Policy does not limit any rights or remedies available to Tool-O under:
- the Terms of Use;
- applicable law;
- any other Platform policy.
7.10 Changes to this Policy
Tool-O may amend this Acceptable Use Policy from time to time.
The most current version published on the Platform replaces all previous versions.
Continued use of the Platform after an updated version becomes effective constitutes acceptance of the revised Policy to the extent permitted by law.
