Code of Conduct

This Code of Conduct establishes the standards of behaviour expected from all Users of the Tool-O Platform.

1. INTRODUCTION

1.1 Purpose

This Code of Conduct establishes the standards of behaviour expected from all Users of the Tool-O Platform.

It promotes a safe, respectful and trustworthy marketplace where Owners, Borrowers and all other Users can interact with confidence.

1.2 Application

This Code applies to all Users of the Platform, including:

  • Owners;
  • Borrowers;
  • visitors;
  • employees;
  • contractors;
  • service providers where applicable.

1.3 Objectives

This Code seeks to:

  • promote respectful behaviour;
  • encourage honest communication;
  • protect User safety;
  • support fair dealings;
  • maintain confidence in the Platform;
  • foster a positive community.

1.4 Relationship with Other Policies

This Code should be read together with the:

  • Terms of Use;
  • Community Guidelines;
  • Acceptable Use Policy;
  • Content Policy;
  • Privacy Policy;
  • all other Platform policies.

1.5 Compliance

Users are expected to comply with this Code whenever using the Platform or participating in activities connected with Tool-O.

1.6 Updates

Tool-O may amend this Code of Conduct from time to time.

The most current version published on the Platform replaces all previous versions.

2. PROFESSIONAL BEHAVIOUR

2.1 Respect

Users must treat others with courtesy, professionalism and respect at all times.

2.2 Honesty

Users should communicate honestly and accurately.

Users must not intentionally provide false, misleading or deceptive information.

2.3 Fair Dealing

Users are expected to deal fairly with one another throughout the entire Booking process, including:

  • Listings;
  • enquiries;
  • Bookings;
  • handovers;
  • returns;
  • reviews;
  • Claims.

2.4 Communication

Users should communicate in a respectful, timely and constructive manner.

Abusive, threatening or offensive communications are not acceptable.

2.5 Harassment

Users must not engage in:

  • bullying;
  • intimidation;
  • discrimination;
  • harassment;
  • stalking;
  • hate speech;
  • abusive behaviour.

2.6 Privacy

Users must respect the privacy of others.

Personal information obtained through the Platform must only be used for legitimate Booking-related purposes unless otherwise permitted by law.

2.7 Property

Borrowers should treat rented Tools with reasonable care and Owners should present Tools honestly and accurately.

Users should respect each other's property throughout every Booking.

2.8 Reliability

Users should make reasonable efforts to:

  • attend agreed handovers;
  • return Tools on time;
  • communicate delays promptly;
  • honour confirmed Bookings where reasonably possible.

2.9 Reviews

Reviews should be:

  • truthful;
  • relevant;
  • respectful;
  • based on genuine experiences.

Users must not manipulate or misuse the review system.

2.10 Community Responsibility

Every User contributes to the reputation and success of the Tool-O community.

Users are encouraged to promote trust, cooperation and respectful behaviour in all interactions.

3. PROHIBITED CONDUCT

3.1 Illegal Activity

Users must not use the Platform for any unlawful purpose or engage in conduct that breaches applicable laws.

3.2 Fraud

Users must not:

  • commit fraud;
  • attempt fraud;
  • misrepresent identity;
  • submit false information;
  • falsify evidence;
  • manipulate Bookings;
  • misuse payment systems.

3.3 Platform Abuse

Users must not:

  • interfere with Platform operations;
  • bypass Platform processes;
  • attempt unauthorised access;
  • exploit software vulnerabilities;
  • misuse automated systems;
  • disrupt other Users.

3.4 Unsafe Behaviour

Users must not knowingly engage in behaviour that creates an unreasonable risk to:

  • people;
  • property;
  • Tools;
  • the Platform.

3.5 Misuse of Tools

Borrowers must not intentionally misuse, abuse or deliberately damage rented Tools.

Owners must not knowingly provide unsafe, prohibited or materially defective Tools.

3.6 Offensive Conduct

Users must not engage in:

  • threatening behaviour;
  • abusive conduct;
  • discriminatory conduct;
  • hate speech;
  • harassment;
  • intimidation;
  • retaliation against other Users.

3.7 Intellectual Property

Users must respect the intellectual property rights of others and must not upload or distribute infringing content.

3.8 False Reviews

Users must not:

  • submit fake reviews;
  • pressure others to provide positive reviews;
  • retaliate through reviews;
  • manipulate ratings;
  • exchange reviews for benefits.

3.9 Privacy Violations

Users must not misuse another person's personal information or disclose confidential information without appropriate authority or legal permission.

3.10 Consequences

Breaches of this Code may result in action under the Terms of Use, including warnings, removal of content, suspension of Listings, restriction of Accounts or termination of Platform access where appropriate.

4. ENFORCEMENT

4.1 Reporting Concerns

Users are encouraged to report conduct that reasonably appears to breach this Code or any other Platform policy.

Reports should be made honestly, accurately and in good faith.

4.2 Investigation

Tool-O may investigate alleged breaches using information including:

  • Booking records;
  • messages;
  • photographs;
  • videos;
  • reviews;
  • Claims;
  • payment records;
  • other relevant information.

4.3 Interim Measures

During an investigation, Tool-O may take reasonable interim action including:

  • temporarily restricting Listings;
  • suspending Bookings;
  • restricting Account functionality;
  • preserving relevant information;
  • requesting additional information.

4.4 Enforcement Action

Where Tool-O reasonably believes that a User has breached this Code, it may take action including:

  • providing guidance;
  • issuing warnings;
  • removing content;
  • restricting Listings;
  • cancelling or restricting Bookings;
  • suspending Accounts;
  • permanently terminating Platform access.

4.5 Fair Process

Where reasonably practicable, Tool-O will seek to assess alleged breaches fairly and impartially based on the available information.

4.6 User Cooperation

Users are expected to cooperate reasonably with investigations conducted under this Code.

Failure to cooperate may be considered when determining appropriate action.

4.7 No Waiver

Failure by Tool-O to enforce any provision of this Code at any time does not constitute a waiver of its rights.

4.8 Policy Updates

Tool-O may amend this Code of Conduct from time to time.

The most current version published on the Platform replaces all previous versions.

4.9 Relationship with Other Policies

This Code of Conduct should be read together with the:

  • Terms of Use;
  • Community Guidelines;
  • Acceptable Use Policy;
  • Content Policy;
  • Privacy Policy;

Where there is any inconsistency, the Terms of Use prevail to the extent permitted by applicable law.

4.10 Final Statement

The success of Tool-O depends upon trust, integrity and mutual respect.

Every User plays an important role in creating a safe, reliable and professional marketplace for the entire Tool-O community.
